Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of BurstWriter, operated by Tastic Consumer Brands LLC (“we,” “us,” or “our”), at https://burstwriter.ai.

By creating an account or using BurstWriter, you agree to be bound by these Terms. If you do not agree, do not use the service. If you are using BurstWriter on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

BurstWriter is an AI-powered SEO blog writing and publishing platform. The service:

• Generates SEO-optimized blog content from your topics, RSS feeds, and brand settings
• Publishes content directly to connected websites (WordPress, Wix, and others)
• Optionally syncs published content to SocialBurst for social media distribution
• Provides SEO performance data via Google Search Console integration
• Offers agency features for managing content publishing across multiple client websites

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Account Registration

• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your password and account credentials.
• You must be at least 13 years of age to use BurstWriter.
• Each account is for a single person or organization. You may not share accounts.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at tasticconsumerbrands@gmail.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree to use BurstWriter only for lawful purposes and in accordance with these Terms. Specifically:

• You may publish only content you have the rights to publish.
• You must not publish content that is illegal, defamatory, harassing, obscene, or that infringes on any intellectual property rights.
• You must comply with the terms of service of each connected platform (WordPress, Wix, Google, etc.).
• You agree not to use BurstWriter to send spam, distribute malware, or publish deceptive or misleading content.
• You agree not to attempt to circumvent platform rate limits, anti-spam measures, or access controls.

5. Subscription and Payment

BurstWriter offers the following subscription plans, billed monthly:

• Free — limited articles per month at no charge
• Starter — $19/month
• Pro — $49/month
• Agency Starter — $99/month
• Agency Pro — $199/month
• Agency Unlimited — $299/month

Payments are processed by Stripe. Subscriptions renew automatically each month. All payments are non-refundable except where required by applicable law. You may cancel at any time from your account settings to stop future charges; your access continues until the end of the current billing period.

We reserve the right to change pricing with at least 30 days’ notice to active subscribers.

6. Content Ownership

You retain full ownership of all content you create, upload, or publish using BurstWriter, including AI-generated content produced at your instruction. We make no copyright claim over any output generated on your behalf.

By using the service, you grant Tastic Consumer Brands LLC a limited, non-exclusive, royalty-free license to store, transmit, and publish your content solely as directed by you through the BurstWriter interface. This license terminates when you delete the content or close your account.

7. AI-Generated Content

BurstWriter uses Anthropic Claude and OpenAI APIs to generate article content from your inputs (topics, brand settings, RSS feeds, and other context you provide).

• You are responsible for reviewing AI-generated content before publishing. We recommend reviewing all articles for accuracy, tone, and compliance with applicable laws before they go live.
• Your content and inputs are not used to train external AI models. We use Anthropic and OpenAI APIs subject to their respective usage policies.
• Stock imagery in generated articles is sourced from Unsplash and is subject to the Unsplash License.

We do not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose.

8. Third-Party Platforms

BurstWriter integrates with third-party platforms including WordPress, Wix, Google Search Console, SocialBurst, Anthropic, OpenAI, Stripe, and others. Your use of those platforms is subject to their respective terms of service and privacy policies.

• Platform outages, API changes, or account suspensions by third parties are outside our control and do not constitute a breach of these Terms.
• You are responsible for maintaining your accounts on connected platforms in good standing.
• We are not liable for any data loss, content removal, or publishing failures caused by third-party platform policies or technical issues.

9. Prohibited Uses

The following are expressly prohibited:

• Reselling or sublicensing access to BurstWriter without our written permission
• Attempting to reverse engineer, decompile, or access non-public APIs or systems
• Using the service to violate any applicable law or regulation
• Circumventing platform rate limits, anti-spam systems, or access controls
• Generating or publishing intentionally misleading, deceptive, or fraudulent content using AI
• Using BurstWriter to interfere with or disrupt the integrity or performance of the service

Violation of these prohibitions may result in immediate account suspension or termination.

10. Termination

By you: You may terminate your account at any time by canceling your subscription and requesting account deletion at tasticconsumerbrands@gmail.com. Your data will be deleted as described in our Privacy Policy.

By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice where practicable.

Upon termination, your right to access the service ends immediately. Provisions that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, governing law) will remain in effect.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• We do not guarantee uninterrupted or error-free operation of the service.
• We do not guarantee the accuracy, quality, or suitability of AI-generated content.
• We do not guarantee specific publishing success rates, SEO performance improvements, or traffic outcomes.
• Use of the service is at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTIC CONSUMER BRANDS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF BURSTWRITER.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Tastic Consumer Brands LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of or access to BurstWriter; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you publish or distribute through the service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or your use of BurstWriter shall be resolved in the courts of the United States. You consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page with an updated “Last updated” date.

For material changes, we will provide at least 30 days’ notice by email to active subscribers. Your continued use of BurstWriter after changes take effect constitutes your acceptance of the revised Terms.
